These Terms of Service ("Terms") govern your access to and use of merchantaccountoutlet.online (the "Site") and the merchant services, point-of-sale ("POS") equipment placement, and payment processing referral services (collectively, the "Services") offered by Merchant Account Outlet Inc ("Merchant Account Outlet," "MAO," "we," "us," or "our"). By accessing the Site, submitting a consultation request, or applying for a merchant account through us, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.

1. Acceptance of Terms

By using the Site or requesting our Services, you represent that you are at least 18 years old, are authorized to act on behalf of the business you represent, and agree to comply with these Terms and our Privacy Policy, which is incorporated into these Terms by reference.

2. Description of Services

Merchant Account Outlet Inc helps business owners obtain point-of-sale equipment (including Clover Duo, Exatouch, and Tableturn systems), credit and debit card processing, and ACH processing through our network of payment processing and banking partners. We act as an independent sales organization and equipment placement provider; we are not a bank, and we do not directly hold or issue merchant accounts. Actual card and ACH processing services are provided pursuant to a separate merchant processing agreement between you and the applicable processor and issuing bank.

3. Eligibility

Our Services are available to businesses operating lawfully in the United States. You must provide accurate, current, and complete information about yourself and your business when requesting a consultation or applying for a merchant account, and you are responsible for keeping that information up to date.

4. Merchant Account Application & Underwriting

Submitting a consultation request or application through the Site does not guarantee approval for a merchant account or POS equipment placement. All applications are subject to review, underwriting, and approval by our processing and banking partners, who may request additional documentation, decline an application, or set pricing and terms based on your business's risk profile, processing history, and industry. Equipment placement offers ("free" equipment, waived fees, or promotional pricing) are subject to underwriting approval and the specific processing agreement you sign, and may not be available to every business.

5. Pricing, Fees & Equipment

Processing rates, equipment placement terms, and any fees are disclosed to you in writing before you sign a processing agreement with our partner processor. Marketing claims on the Site regarding savings, "zero processing fees," or equipment cost estimates are general and illustrative; your actual rates and savings depend on your business's card volume, average ticket size, industry, and the terms of the agreement you enter into with our processing partner. POS equipment provided under a placement program remains subject to the terms of that program, including any requirements to maintain minimum processing volume or return the equipment if the agreement ends early.

6. SMS / Text Messaging Terms

By providing your mobile phone number to us — including through a consultation request form, a phone call, or a text message you send us — you consent to receive text messages (SMS/MMS) from Merchant Account Outlet Inc regarding your consultation, application status, equipment setup, account support, and appointment reminders. If you separately opt in to marketing texts, you may also receive promotional messages about our Services.

  • Message frequency: varies based on your interactions with us.
  • Cost: message and data rates may apply, based on your mobile carrier plan.
  • Opt-out: reply STOP at any time to cancel text messages. You will receive one final message confirming your opt-out.
  • Help: reply HELP for assistance, or contact support@merchantaccountoutlet.online or (303) 847-9119.
  • Carriers: supported carriers are not liable for delayed or undelivered messages.

Your consent to receive text messages is not a condition of purchasing any Services. See our Privacy Policy for how we handle information collected through text messaging.

7. Electronic Communications Consent

You consent to receive communications from us electronically, including by email, text message, and phone, at the contact information you provide. You agree that all agreements, notices, and disclosures we provide electronically satisfy any legal requirement that such communications be in writing.

8. User Responsibilities

You agree not to: (a) provide false or misleading information in a consultation request or merchant account application; (b) use the Site for any unlawful purpose; (c) attempt to interfere with the security or proper functioning of the Site; or (d) use the Site to submit an application on behalf of a business you are not authorized to represent.

9. Intellectual Property

The Site, including its text, graphics, logos, and design, is owned by or licensed to Merchant Account Outlet Inc and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, or create derivative works from the Site without our prior written consent.

10. Third-Party Products & Trademarks

Clover, Clover Duo, Exatouch, and Tableturn are trademarks of their respective owners. References to these products on the Site are for identification purposes only and do not imply endorsement by, or affiliation with, those trademark owners beyond our role as an authorized reseller or equipment placement provider. Your use of any third-party POS hardware or software is also subject to that provider's own terms and warranties.

11. Disclaimers

THE SITE AND ANY INFORMATION PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT PROCESSING RATES, EQUIPMENT OFFERS, OR SAVINGS ESTIMATES DESCRIBED ON THE SITE WILL BE AVAILABLE TO ANY SPECIFIC BUSINESS, AS ALL OFFERS ARE SUBJECT TO UNDERWRITING APPROVAL.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MERCHANT ACCOUNT OUTLET INC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS WILL NOT EXCEED THE FEES YOU PAID DIRECTLY TO MERCHANT ACCOUNT OUTLET INC (EXCLUDING FEES PAID TO A THIRD-PARTY PROCESSOR OR BANK) IN THE SIX MONTHS BEFORE THE CLAIM AROSE.

13. Indemnification

You agree to indemnify and hold harmless Merchant Account Outlet Inc, its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Site or Services.

14. Termination

We may suspend or terminate your access to the Site at any time, without notice, for conduct that violates these Terms or is otherwise harmful to us or other users. Termination of your access to the Site does not affect any separate merchant processing agreement you may have entered into with a third-party processor or bank.

15. Governing Law & Disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in Douglas County, Colorado, and you consent to personal jurisdiction in those courts.

16. Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted to this page, and we will update the "Last Updated" date above. Your continued use of the Site or Services after a change constitutes acceptance of the revised Terms.
